In this two week trial against a Fortune 500 Specialty Retailer, the plaintiff sought a demand of $20M for crippling neck injuries claimed to have been caused by negligence.

  • The plaintiff’s injury treatment plan, which did not commence until a month after the incident.

  • Video featuring the plaintiff:
    • Being pushed in a wheelchair with O2 tubing in nose during court, and then jumping out of the wheelchair, placing O2 equipment in trunk and walking around in the parking lot.
    • Walking around several stores without assistance on several occasions.
    • On a boat partying the day of the accident and the day before the first physician visit.

This type of evidence is not out of the ordinary, but the fact that it could be shown is what made the difference.
